Business Owner Visa (subclass 890)

With this visa, you can:

  • Secure permanent residency in Australia.
  • Engage in work and education within the country.
  • Enrol in Australia’s comprehensive public healthcare program, Medicare.
  • Act as a sponsor to bring your relatives to Australia.
  • Enjoy the privilege of multiple travels to and from Australia for a duration of 5 years.
  • Subject to meeting eligibility criteria, pursue Australian citizenship.

How It Works

You can include eligible family members in your application for an extra cost per person. Additional family members that are 18 years old or older must have a level of functional English, or there will be an extra charge of $4890 per person. This charge is known as the second instalment, and will be refunded if the visa is not granted.

Duration

This is a permanent visa however there are conditions. For the first 5 years after your visa has been granted, you can travel to and from Australia without restriction. If your desire is to travel beyond the initial 5-year period, the following steps are necessary:

  • Submit a successful application for a Resident Return Visa (subclasses 157 and 155) to obtain permission for re-entry into Australia as a permanent resident.
  • Additionally, it is worth considering the option of acquiring Australian citizenship. By becoming an Australian citizen, you eliminate the need for a visa when entering Australia. It is important to note that you will still be required to apply for an Australian passport, which you will utilize for exiting and re-entering Australia.

In the event that you depart Australia after the expiration date of your travel facility without obtaining another valid travel facility through a permanent visa, such as a Resident Return Visa, it will not be possible to re-enter Australia as a permanent resident. 

Eligibility

You must be in Australia when you submit the application for this visa. You must also be the primary holder of a visa in any of the following visa subclasses: 

  • Business Owner (Provisional) visa (subclass 160)
  • Senior Executive (Provisional) visa (subclass 161)
  • Investor (Provisional) visa (subclass 162)
  • State/Territory Sponsored Business Owner (Provisional) visa (subclass 163)
  • State/Territory Sponsored Senior Executive (Provisional) visa (subclass 164)
  • State/Territory Sponsored Investor (Provisional) visa (subclass 165)
You must have resided in Australia on an eligible visa for a cumulative duration of at least one year within the two-year period preceding your application. It is important to note that this one-year period does not need to be consecutive.
You also need to meet the following criteria for the two years leading up to your application:
 
  • Hold an ownership interest in one or more actively operating primary businesses in Australia.
  • Provide evidence of your ownership interest in each nominated main business, along with its value.
  • Your ownership interest or the combined ownership interest of you and your partner must meet at least one of the following criteria within the two-year period:
    1) 51% ownership in a business with an annual turnover below AUD 400,000.
    2) 30% ownership in a business with an annual turnover of AUD 400,000 or more.
    3) 10% ownership in a publicly listed company.
  • Demonstrate your direct and continuous management role in each main business on a day-to-day basis, even during periods when you are outside of Australia.
  • Ensure that each main business meets the requirements to be considered a qualifying business.
  • Obtain an Australian Business Number (ABN) for each main business, with a maximum of two ABNs allowed.
  • Provide evidence of Business Activity Statements issued by the Australian Taxation Office through the portal process.
If you were absent from Australia for more than six weeks in total during the two-year period, explain how you managed the business during your absence.
